The new rights have generally been acquired independently of the political power even if they have been institutionalized afterwards. The changes in the Chinese economy and the reform of the legal system did transform the state and the society, but brought little change to the interactions between state and society. The pseudo Marxist rhetoric prevails in the legal system and the political interpretation of the law veils the very real progress of the system. The contradictions within the Chinese society, which appear in the legal system, are justified by a discourse aimed to cut short of any kind of political transformation of the system.
