The development of strategic litigation regarding the protection of biodiversity: The case of underground badger hunting with dogs

Confronted with a growing number of legal actions against the additional period of underground badger hunting with dogs, administrative judges have been forced for several years to base their decisions on the abundant scientific literature about this species. This led them to build a case law that, besides being coherent from a scientific point of view, is in line with the founding principles regulating hunting set out in the environmental code. Far from being insignificant, this litigation has transversal implications and leads to the forging of solid precedents in matters of biodiversity protection.
