The recent declarations of the president of the Republic concerning the tabling in the coming months of a bill to reform the Legislation of 1945 with the aim of returning to the humanist ambitions of the original text can only be taken seriously if they go hand in hand with a detoxification of minds profoundly impregnated by the ideology of security and the invasion of neoliberal concepts concerning efficiency. It is important to abandon a penal policy preventing magistrates from individualizing their decisions and to return to the preoccupations of current research which is interested in strategies for overcoming or getting out of delinquency and in the relevance of diverse educative instruments before and after the judicial intervention. There are three requirements for achieving this: a procedure that respects the different perceptions of temporality; the abandonment of the systematic progressive nature of sanctions; and the resumption of a diversification of forms of equipment.
