This study shows how the implementation of a performance bonus in high courts can be understood as reward politics, or as a manner of governing judges and attorneys. Measuring and putting a price on productivity appears as a political means to incentivize some law professionals to work “faster” and “more efficiently.” This emulation mechanism relies on an individualization and differentiation of judges. Based on a specific ethos, the esprit de corps is challenged by this new public management technique. Creating competition within jurisdictions implies distinctions and conflicts thereby making personal power within the judicial hierarchy possible. This study, based on semi-directive interviews, proposes a political analysis of some of the issues surrounding the trend of managerialization of justice.
