A minor who is victim of an offense can only file criminal charges through the intermediary of his/her legal representatives. In cases where the parents fail to execute this role or in which they are the perpetrators of the offense, a legal guardian is appointed, but only for the duration of the legal proceeding. The legal guardian instructs a lawyer. The lawyer will advise the legal representative on all decisions related to the proceeding and suggest what is in the child’s best interest. The lawyer meets the child to explain the course of the proceeding and to help him/her clarify the facts. All decisions involved in the criminal proceeding (appeal, claim for damages, etc.) are made by the legal representative, who is advised by the lawyer.
