Care programs: What responsibilities?

Care programs, as a care modality in involuntary outpatient commitment, were introduced into the psychiatric care system by law 2011-803 of July 5, 2011. Since their establishment, legal experts have seen them as a ULO (unidentified legal object). Their complex legal classification leads to a tangle of contentious risks related to responsibility: What responsibilities? For whom? The legal decision to implement (or not) a care program may have harmful consequences, leading to attempts to search for and to determine the share of responsibility that can be attributed to each actor: the administrative authority that signed the measure (1); the patient (2); the psychiatrist (3); and even, as some wish, the legislator itself (4).
