Fetomaternal hemorrhage (FMH) can, in certain cases, have medico-legal implications (including intrauterine fetal death or cerebral injury resulting from fetal anemia, particularly following maternal trauma). Assessing such cases can prove complex and requires a panel of legal experts, including an obstetrician, a neonatologist, and a pediatric radiologist. Several key issues must be tackled: confirming whether a FMH actually occurred; assessing the volume of the FMH and relating it to the gestational age; specifying the time of the onset of the FMH; carefully reviewing fetal imaging, particularly MRI, to verify whether the brain lesions are indicative of severe acute or chronic fetal anemia and not of typical anoxia; and assessing the consistency between the cerebral anomalies identified and the newborn’s clinical presentation.
