Freedom of expression is crucial for historical research, but it must also be regulated to prevent the spread of falsehoods, especially concerning serious violations of fundamental rights. Many European countries, including Belgium, sanction Holocaust denial and other genocides. The law should thus strike a delicate balance between promoting truth, or even the “right to the truth,” and suppressing distortions of historical reality, without imposing an “official” version of history. The challenge is to safeguard the memory of major crimes while fostering free research, for the greater benefit of the shared history that is its focus.
