The legal definition of jewish identity remains a major controversy within the Israeli democracy. On the one hand, the Law of Return gives every Jew in the world the right to live in Israël and to gain Israeli citizenship. But on the other hand, the legal definition of “Who is a Jew?” never had got any consensus, creating multiple and recurring political and institutional crisis among the Knesset, the Rabanout and the High Court of Justice. This article retraces the main developments of the “Who is a Jew?” conflict, attempting to identify its main issues and to demonstrate that each compromise solution brings the crisis to come. Thus, the “Who is a Jew” conflict demonstrates both the high level of ideological and religious fragmentation of contemporary Jewish world than the persistence of a “common” that can’t find a legal translation.
