European citizens now have the right to vote and are eligible in municipal and European elections in the EU country in which they live and of which they are not citizens (Article 8B of the Maastricht treaty). This innovative provision of the law breaks with an old principle in nation states in which political citizenship is firmly anchored to nationality. But it is only its generalization that is innovative : French reluctance in this area should not hide the foreign experiences, which are often extended to all non-nationals. The aim in this comparative survey is to look at the implementation but also the distortions and postponements to which certain countries have had recourse in the transposition of the provisions of this article in national electoral law. In all cases, the changes in election law go to the heart of nation-building and identity definition. This is how the application of these new political rights in the Union will be construed.
