Pierre-Louis Roederer was an emblematic figure of the Assemblée Constituante, and his role in the success of the coup d’etat of 18 Brumaire An VIII was key. He was furthermore one of the first contingent of jurists who thronged the Conseil d’État. A close look at his work as President of the section de l’Intérieur offers a great deal of information on the practice of jurisprudence at the beginning of the 19th century, a subject which, alongside moral philosophy and political economy, was considered at the time to be a discipline within the science of social organisation. Study of Roederer’s efforts to establish a representative regime based on property interests reveals not only his aims but also shows us the way in which jurisprudence was pursued during the very beginning of the Consulate. In his struggle for free trade and industry, Roederer made the reality of production relationships the principal criterion of the legitimacy of the rule of law. However, the influence of social science on his juridical action manifested itself for the most part in his constitutional work. Just like a good number of his colleagues at the Institut, Roederer adopted a very broad conception of the political machine whereby social science could allow the re-establishment of order when helped by mechanisms designed also to shore up the executive. It would also ensure a real representative quality for the Consular institutions.
