Conditioned by the historical heritage and the geographic distance of the territories concerned, overseas law is characterized mainly by the distinction between the regimes of legislative specialty and identity, leading to important differences in the local applicability of laws and regulations. The important normative competences that can be attributed to the overseas communities, including in the legislative field, determine the distinctive characteristics of the judicial review of local laws. Insufficiently updated and accessible, overseas law falls short of the requirements of judicial security.
