This article traces the origins of regulatory competition in the economic analysis of law and confronts this predominantly North American economist discourse with the European integrationist one. Regulatory competition derived from utilitarian concepts still exists in the European Union. However, the dialectic between the harmonization of laws and the autonomy of Member States reduces the scope of this economic competition. Moreover, it raises questions about the emergence of an attractiveness of national laws not exclusively based on economic values.
