This commentary on Edmond Picard’s Le droit pur (1899) intends to underline the extent to which the Belgian lawyer employs physical anthropology to build his philosophy of law. Picard uses – though with many mistakes – the science of race of his time extensively. He especially draws on Gustave Le Bon’s writings to suggest that law and race are intimately linked, which allows him to justify his antisemitism. This text constitutes one of the very few explicit uses of the science of race by a well-known jurist.
