Les restructurations et les licenciements collectifs ont fait la une de la presse nationale et régionale, ou tout au moins ont occupé, ces dernières années, une place de choix dans les pages économiques et/ou judiciaires. Pour autant les chercheurs se sont peu penchés sur la contestation judiciaire et juridique menée par les élus du personnel et sur les relations entretenues avec leur avocat. À partir des archives professionnelles de l’avocat Tiennot Grumbach, l’article relate l’épisode juridique de cinq restructurations d’entreprise. Dans un premier temps, il tente de saisir l’usage syndical par le bas des élus syndicaux en s’intéressant à leur mobilisation du droit et son articulation avec d’autres modes d’actions. Dans un deuxième temps, l’article s’interroge sur les raisons du recours au droit et à T. Grumbach par les représentants du personnel. L’engagement d’une procédure par les élus pour contester la restructuration leur permet de gagner du temps, d’encadrer la mobilisation et les salariés, et de peser dans les négociations avec la direction de leur entreprise. The restructurings and mass redundancies have made the headlines of the national and regional press, where both have, at the very least, occupied a special place in the economic and/or legal sections over the past years. However, researchers have dealt insufficiently with the judicial and legal dispute led by elected staff representatives and on the relations maintained with their lawyer. Starting from the professional archives of the lawyer Tiennot Grumbach, the article relates the legal episode of five company restructurings. At first, it tries to understand the use of the labor union from the bottom up by labor union elected representatives, in concerning itself with their mobilization of the law and the linkage between this and other modes of actions. Secondly, the article questions the motives behind the appeal to the law and to T. Grumbach by staff representatives. The initiating of proceedings by the elected representatives to dispute the restructuring allows them to save time, to supervise the mobilization and the employees, and to weigh up the negotiations with the management of their company.
