Malgré un enracinement profond dans le vocabulaire du droit constitutionnel, la notion de suffrage universel indirect, généralement utilisée pour rendre compte du rôle du Sénat, est non seulement loin d’être claire par elle-même mais présente d’importantes difficultés historiques, théoriques et juridiques. Son histoire épouse celle des rapports complexes entretenus entre le suffrage universel et le gouvernement représentatif depuis la Révolution française et ne prend tout son sens que dans une perspective de théorie constitutionnelle. Si elle révèle comment se construisent les justifications constitutionnelles, elle en dit également beaucoup sur la manière dont se forgent et se diffusent les concepts en droit constitutionnel. Although deeply rooted in the vocabulary of constitutional law, the notion of indirect universel suffrage, commonly used to account for the role of the French Senate, not only is far from being self evident but also raises important historical, theorical and legal difficulties. Its history accompanies that of the complex relationships between universal suffrage and representative government since the French Revolution and only adquires its full significance within the perspective of a constitutional theory. It reveals the way constitutional justifications are construed and tells a lot about the forging and the difusion of constituional legal concepts.
