| Summary, etc. | RésuméDepuis 2009, et jusqu’en 2012, une expérimentation sociale financée par la Direction générale de la cohésion sociale est menée introduisant un pôle juridique « Accès au droit et santé mentale » au sein de trois établissements hospitaliers parisiens suivants : le Centre hospitalier Sainte-Anne, le Groupe public de santé Perray Vaucluse et l’unité de psycho-traumatologie de Tenon AP-HP. Porté par l’association Droits d’Urgence et destiné à renforcer l’accès au droit et aux soins des personnes souffrant de troubles psychiatriques ou psychiques en situation d’exclusion, ce nouveau dispositif opère à deux niveaux : en renforçant directement l’accompagnement juridique auprès des personnes vulnérables bénéficiaires et en soutenant ponctuellement à travers l’expertise du droit les équipes médico-sociales des établissements. Pour ce faire, une méthodologie d’intervention ad hoc a été pensée autour de différents leviers, cumulatifs : réunion de commissions techniques, organisation de permanences juridiques, d’actions de sensibilisation, mutualisation d’outils et d’informations juridiques. Ainsi conçu et développé sur les trois sites hospitaliers partenaires, ce dispositif, intégré et subsidiaire, permet à la fois de mieux appréhender la complexité des situations des personnes démunies, pour lesquelles les difficultés sociales, médicales, administratives et juridiques se cumulent et s’imbriquent souvent, et de tenir compte de leurs vulnérabilités. Ce travail transversal et décloisonné implique médecins, travailleurs sociaux et juristes autour des patients, acteurs et sujets de droit. |

| Summary, etc. | Legal empowerment and mental health: the legal subject in hospitalsA social experiment and pilot project funded by the French Directorate General of Social Cohesion aimed at providing legal aid services (“legal empowerment and mental health”) has been conducted since 2009 in three healthcare institutions in Paris (France): the Centre Hospitalier Sainte-Anne, the Groupe Public de Santé Perray-Vaucluse, and the Hôpital Tenon (psychotraumatology unit). Lasting until 2012 and piloted by the NGO Droits d’Urgence, the initiative aims to promote the legal empowerment of socially excluded people suffering from psychiatric or mental disorders and to facilitate access to care. The initiative operates on two levels, providing legal support to vulnerable people and offering legal expertise and advice to medical and social staff. An ad-hoc intervention approach was designed to ensure the implementation of the initiative based on several combined tools: legal aid, technical committees, awareness-raising activities, and pooling of legal resources and information. Developed across the three institutions, this integrated and subsidiary initiative improves our understanding of the complex circumstances of disempowered people – who are often faced with overlapping social, medical, administrative and legal difficulties – and helps to take into account their vulnerabilities. The cross-professional and cross-boundary system promoted by this initiative involves medical staff, social workers and lawyers around patients viewed as both actors and legal subjects. |
