| Summary, etc. | Différents travaux ont déjà analysé les politiques de contrôle de la traite des êtres humains et d’accompagnement de ses victimes à partir de leur mise en œuvre policière et associative. Le procès pour traite à des fins d’exploitation sexuelle, instance ultime de qualification des faits, est cependant resté relativement sousexploré, en dépit de son caractère central dans la production d’une « vérité judiciaire » et l’identification des victimes et auteur·es. À partir d’une ethnographie conduite dans des tribunaux français et allemands, il s’agit ici d’interroger la production pénale de la figure de victime d’exploitation sexuelle au sein de deux modèles législatifs que l’on oppose couramment en matière de régulation de la prostitution et du proxénétisme. Par-delà les contrastes, on développera l’idée que la figure de la victime de traite à des fins d’exploitation sexuelle, en raison des projections sexualisées et racialisées dont elle fait l’objet, révèle avant tout une certaine conception de la femme et de son rapport à la nation. |

| Summary, etc. | Various studies have already addressed the policies for controlling trafficking in human beings and assisting its victims based on the analysis of their implementation by the police and associations. However, the trial for trafficking for sexual exploitation, the ultimate authority for qualifying the facts, has remained relatively under-explored, despite its central character in the production of a "legal truth" and the identification of victims and perpetrators. Based on an ethnography conducted in French and German courts, the aim here is to examine the criminal production of the figure of the victim of sexual exploitation within two different legislative models regarding the regulation of prostitution and pimping. Beyond the contrasts, I will develop the idea that the figure of the victim of trafficking for the purpose of sexual exploitation, because of the sexualized and racialized projections to which she is subjected, tells above all the story of a certain idea of women and their relationship to the nation. |
