| Summary, etc. | RésuméLa loi du 8 janvier 1993, qui a fait entrer pour la première fois l’accouchement sous X dans le Code civil, a aussi donné à cette vieille institution des allures surprenantes. Loin de se limiter, comme auparavant, à tenir secrète l’identité de la femme, elle crée une fiction légale d’après laquelle l’accouchement est réputé n’avoir jamais eu lieu. Un bref rappel historique de la maternité secrète permet de rendre compte de l’invention de cette institution troublante, des fonctions qu’elle a remplies dans l’ordre de la filiation et des forces juridiques qui annoncent sa disparition certaine. |

Indeed, not only is the mother allowed, as before, to remain totally anonymous, but it also forges a legal fiction according to which the deliverance never actually took place. Through a brief survey of the history of secret maternity, we mean to account for the invention of this institution, to investigate the function it fills and show the judicial forces that foretell its definitive abolition. |
