| Summary, etc. | Cet article décrit la relation entre la construction sociale de la légalité et l’association public-privé dans le système de santé en Calabre, en se concentrant notamment sur les processus d’autorisation pour l’exercice des activités sanitaires et l’externalisation des services. Selon la perspective sociologique néo-weberienne utilisée dans la recherche, la construction sociale de la légalité concerne les relations entre institutions, organisations, acteurs concernant la non-observation/ la manipulation / la violation systématique de la norme juridique dans la gouvernance de la politique sanitaire, une « politique critique » pour les interactions multiples entre sphères de régulation différentes, plusieurs ressources et intérêts en jeu. Aux données issues de la reconstruction de la législation de référence et de l’analyse des sources secondaires, cet article combine aussi les représentations des témoins privilégiés et des acteurs qualifiés collectées par des entretiens semi-structurés selon lesquels la crise de la légalité dans le système sanitaire calabrais prend la forme d’une association public-privé faible du point de vue structurel, organisationnel et technologique qui s’est développé selon une relation complémentaire visant à inciter non plus à l’exhaustivité, à la qualité et à l’efficacité des performances et des services comme prévus par la loi, en tant que système d’opportunité pour la consolidation des positions de pouvoir économique, politique et social des groupes d’intérêts variés. |

| Summary, etc. | This article describes the relationship between the social construction of legality and the public-private mix in the Calabrian healthcare system, focusing on the authorisation and accreditation processes in the exercise of health activities and outsourcing of services. According to the Neo-weberian sociological perspective used in research, the social construction of legality concerns the relationships between institutions, organisations and key players around the non-observance / the manipulation / the systematic violation of the legal norm in health policy, a « critical policy » for multiple interactions between different spheres of social, economic and political regulations at stake. To the data deriving from the reconstruction of the technical legislation and the analysis of secondary sources, this article adds the representations of qualified players gathered through semi-structured interviews. The legality crisis in the Calabrian healthcare system takes the form of a weak public-private mix from a structural, organisational and technological point of view, which has evolved following a complementary relationship aimed at no longer encouraging the comprehensiveness, the quality and the efficiency of the achievements and services as required by the legislation, as a system of opportunity for consolidating the economic, political and social power positions of groups with varied interests. |
