| Summary, etc. | Alors qu’un rapport était remis le 14 janvier 2020 au Premier ministre et à la ministre du Travail sur le maintien en emploi des seniors, afin de « favoriser l’emploi des travailleurs expérimentés »* la présente contribution propose de s’intéresser au « chef d’entreprise senior ». Elle procède à un état des lieux du droit des affaires, pour déterminer comment y sont appréhendées la question de l’âge et l’éventuelle situation de vulnérabilité qui l’accompagne, que ce soit pour l’exploitation d’une entreprise à titre individuel ou pour la direction d’une société. Si l’existence d’un droit de diriger une entreprise devrait pouvoir être affirmée, sur le fondement des libertés individuelles et de l’autonomie individuelle, l’augmentation des exceptions révèle des réticences du législateur, voire des opérateurs eux-mêmes, pouvant remettre en cause son effectivité. |

| Summary, etc. | While a report was submitted on 14 January 2020 to the French prime minister and minister of labor, on ways to keep older workers employed in order to “promote the employment of experienced workers”**, this paper deals with the issue of elderly business leaders. It reviews business law to determine how it deals with age and the potential vulnerabilities that come with it, either in the case of an individual running a firm or in the case of the direction of a company. While the right to run a company should be asserted on the basis of individual freedoms and individual autonomy, the increase in exceptions reveals reluctances of the legislator, and even of the operators themselves, which could imperil the effectiveness of this right. |
