Summary, etc. | Le concept de « parenté d’intention » (traduction des « intented parents » des conventions de gestation pour autrui) s’est imposé en droit français. Il est utilisé pour désigner les projets parentaux qui ne sont pas permis en France et pour lesquels la filiation est difficile à établir, y compris ceux des couples de femmes. Dans cet article, les usages de la notion sont mis en perspective avec le droit de la filiation qui reconnaît déjà des filiations ne reposant pas sur un fondement biologique mais sur la volonté (présomption de paternité, reconnaissance), sans pour autant être qualifiées de filiation d’intention. Ainsi, à travers la parenté d’intention, un droit spécial de la filiation se profile : l’engagement prénatal permettrait, en effet, d’instituer de nouvelles formes de familles. |

Summary, etc. | The concept of “intented parents” resulting from surrogacy agreements is increasingly used in French law. It more specifically refers to parental projects that are not allowed in France and for which filiation is therefore difficult to establish, including in the case of same-sex female couples. In this article, uses of this concept are confronted with French law, which already acknowledges filiations that are based on will (presumption of paternity, recognition of the child) rather than a biological bound, yet do not qualify as kinship of intention. Through intended parenthood, a special filiation right emerges, that of prenatal commitment, which would indeed allow new forms of families to take shape. |
