Summary, etc. | Lorsque la philosophie a voulu penser la propriété et son origine, elle a fait de la nature le cadre approprié pour l’appréhender, y compris à des époques où la propriété, aussi bien privée que commune, était déjà régulée par un système de juridictions préexistant. La propriété et la question de sa légitimité ont alors été interrogées aux confins de l’articulation entre l’ordre du fait (s’incarnant notamment dans l’appropriation) et celui du droit. Néanmoins la mise au premier plan d’une nécessité naturelle ainsi que l’inscription de l’appropriation dans un registre naturaliste ont pour vocation de soustraire la propriété à la problématique de la justice distributive. L’approche naturaliste de l’appropriation privative implique en outre un usage pragmatique de la norme juridique, renversant par là la « loi de Hume », alors même que cette norme pourrait être tout aussi légitimement mobilisée pour instaurer un devoir-être plutôt que pour instituer juridiquement un état de fait. Summary, etc. | When the property and its origin have been conceived in the history of philosophy, they have been interpreted in the framework of nature, including at a time when the property, both private and common, was already regulated by a system of legal norms. The property and its legitimacy were then considered on the borders of facts (like the appropriation) and law. Nevertheless, the foregrounding of a natural necessity and the interpretation of the appropriation in a naturalistic framework tend to set the property aside the issue of distributive justice. Furthermore the naturalistic perspective on private appropriation involves a pragmatic use of the legal norm. The latter reverses the “law of Hume” even though the legal norm could be as legitimately considered to justify the “ought” rather than to establish legally an empirical state of the world. |
