| Summary, etc. | L’extradition est, durant les trois dernières décennies du xixe siècle, une question d’une brûlante actualité, juridique, mais aussi politique. L’étude des débats des internationalistes réunis en l’Institut de droit international et en l’International Law Association permet d’en préciser les enjeux. La plupart des participants à ces débats considèrent que la pratique doit être redéfinie et codifiée parce que l’intensification des circulations rend sa généralisation indispensable, sans cependant que cela n’amène à renoncer à l’octroi par les États libéraux de leur protection aux proscrits parvenus jusque sur leur sol. La flambée anarchiste qui marque l’Europe de fin de siècle rend cependant particulièrement difficile à ces libéraux la définition d’un équilibre permettant de pourchasser le criminel et l’anarchiste sans pour autant repousser le proscrit. Ils n’y parviennent, après plusieurs décennies de débats, qu’au prix d’une criminalisation des répertoires d’action du mouvement anarchiste, élaborant alors une norme internationale dont nous retrouvons la trace dans le droit interne et les pratiques des États du nord-ouest de l’Europe. La connexion entre norme internationale et pratiques nationales est assurée par des agents, dont Louis Renault est pour la France un bon exemple, qui occupent simultanément des positions dominantes dans la sphère internationale et l’ordre juridique interne. |

| Summary, etc. | During the last three decades of the 19th century, extradition was a highly debated issue, both in the legal and political sphere. The study of the debates amongst international lawyers, who gathered in the Institut de droit international and in the International Law Association makes it possible to specify what was. at stake then. Most of the participants in these debates consider that the practice must be redefined and codified because the intensification of circulations makes its a necessary tool for penal justice. These liberal circules wish however to avoid liberal states giving up their right to protect exiles. The task is made difficult by the anarchist upsurge of the century leading them to define a balance that would make it possible to hunt down the criminal and the anarchist without rejecting exiled freedom fighters. They succeed in doing so, after several decades of debate, only at the cost of criminalizing the anarchist movement’s mores, thus elaborating an international norm, the traces of which can be found in the domestic law and practices of the north-western European states. The connection between international standards and national practices is ensured by agents, of which Louis Renault is a good example for France, who simultaneously occupy dominant positions in the international sphere and the domestic legal order. |
