Summary, etc. | Les droits de l’Homme ne vont pas de soi dans de nombreux pays, car ils ont été développés dans une généalogie de la philosophie occidentale des Lumières sur fond d’éthique chrétienne, fondée sur la dignité de la personne humaine. Les principales objections sont donc leur colonisation occidentale et un paternalisme hégémonique à l’égard des autres cultures. Pour que les droits de l’Homme soient acceptés dans le monde entier, ils doivent être justifiés à nouveau du point de vue de toutes les cultures et visions du monde. À cette fin, des « discours mondiaux ouverts » sont proposés dans le but de parvenir à un consensus global, dans lequel l’égalité de statut moral des personnes concernées est déjà prise en compte dans la justification éthique. Pour l’institutionnalisation des droits de l’Homme mondialement fondés, un nouveau contrat social mondial durable est proposé, qui en fait la base constitutionnelle indiscutable de l’ordre mondial. |

Summary, etc. | Human rights are not self-evident in many countries, as they were developed in a genealogy of Western Enlightenment philosophy against the background of Christian ethics, based on the dignity of the human person. The principal objections to human rights are thus their association with Western colonialism characterised by a hegemonic paternalism vis-à-vis other cultures. If human rights are to be accepted worldwide, they must be justified anew from the perspective of all of the cultures and visions of the world. To this end, ’open global dialogues’ are proposed with the goal of reaching a global consensus in which the equal moral status of the persons concerned is already considered in the ethical justification. In order to institutionalise universal human rights, a new sustainable global social contrast is proposed, which makes them the undisputed constitutional basis of the world order. |
