| Summary, etc. | Le recours de plus en plus fréquent aux robots dans la pratique médicale et la prise en charge des patients suscite de nombreuses interrogations éthiques et juridiques, notamment relatives aux éventuelles mises en cause et responsabilités en cas de dommages. Les solutions juridiques ne sont pas forcément inédites dès lors que les robots sont utilisés depuis longtemps dans l’industrie et sont déjà présents dans notre vie quotidienne. Mais leur usage et leur développement en médecine présentent certains risques, obligeant à analyser d’une part la question de la sécurité des dispositifs eux-mêmes et d’autre part la licéité de leur utilisation au regard du respect de la vie privée et des libertés individuelles. |

Robotics and medical technology: Which liability?Nowadays, medical robots become more and more important to better provide care, to remote patients and help to perform surgery. Legal et ethical issues relating to health care robots are not new, but are more complicated, in particular about the assignation of liabilitiy.This article will give an overview of some of the legal issues relating the use of robotics in health care and medical and surgical procedures : first in relation to the safety of these specific devices, and then in relation to the threats to privacy and individual liberties. |
