Summary, etc. | En matière de justice familiale, les affaires qui font l’objet d’une enquête sociale constituent le plus souvent des cas disputés pour lesquels la « solution » ne s’impose pas immédiatement aux juges. Au regard de ce qui conditionne ce type d’évaluation, de la façon dont elle s’écrit et est appropriée par la justice, cet article montre comment l’enquête sociale participe en creux au rétablissement de l’ordre social sexué, essentiellement à l’adresse des familles de classes populaires. L’identification des désordres et la nécessaire légitimation de décisions qui sortent de l’ordinaire par un travail spécifique de mise aux normes (psychologiques, juridiques et morales) met en évidence le poids d’une morale familiale socialement située et les mécanismes savants de son imposition. |

Summary, etc. | Family justice cases needing a social investigation are often those disputed cases in which judges encounter the most difficulties as to their resolution. Taking into consideration what conditions this appraisal and how it is written and integrated during case resolution, this article demonstrates how the social investigation contributes to the restoration of gendered social order, primarily towards working-class families. Specifically, the characterization of disorders and the need to legitimize uncommon decisions reached through the work of normalization (psychological, legal, and moral) shows the importance of socially situated family morality and the erudite mechanisms of its imposition. |
