| Summary, etc. | L’établissement de la Cour pénale internationale ( cpi) et l’adoption du Statut de Rome ont été vus par beaucoup comme un pas en avant dans la défense des droits des femmes à l’échelle internationale, et surtout dans la lutte contre les violences fondées sur le genre dans les conflits armés. Mais l’inclusion du ‘genre’ dans le Statut n’a pas été acquise sans lutte, surtout de la part des ongs des droits des femmes. Dans cet article, nous retraçons l’histoire des débats sur le genre dans le droit pénal international pour rendre compte du processus par lequel les crimes liés au genre ont été reconnus dans le Statut de Rome. Puis nous analysons l’application du droit pénal international dans certains cas de crimes liés au genre pour montrer les obstacles qui persistent à une vraie prise en compte des enjeux de genre par le droit, et enfin nous discutons la façon dont la jurisprudence de la cpi pourrait avoir une influence plus large sur la reconnaissance du genre dans d’autres sphères du droit international ou national. |

| Summary, etc. | Gender, Justice and International Criminal LawThe establishment of the International Criminal Court ( icc) and the adoption of the Rome Statute were viewed by many as a step forward in the defence of women’s rights on an international scale, and above all in the fight against gender-based violence in armed conflicts. But the inclusion of ‘gender’ in the Statute was not acquired without a struggle, especially on the part of women’s rights ngos. In this article, we examine the history of the gender debates in international criminal law, in order to trace the process through which gender-related crimes were acknowledged in the Rome Statute. We then analyse the application of international criminal law to specific cases of gender-related crimes, in order to show the enduring obstacles that prevent gender issues from genuinely being taken into account by law; finally, we discuss the way in which icc jurisprudence could have a wider influence on the acknowledgement of gender in other spheres of international or domestic law. |

| Summary, etc. | El establecimiento de la Corte Penal Internacional ( cpi) y la adopción del Estatuto de Roma han sido vistos por muchos como un paso adelante en la defensa de los derechos de las mujeres en el nivel internacional y sobre todo en la lucha contra las violencias basadas sobre el género en los conflictos armados. Sin embargo la inclusión del ‘género’ en el Estatuto no fue adquirida sin lucha, sobre todo de la parte de las ongs de los derechos de las mujeres. En este artículo, retrasamos la historia de los debates sobre el género en el derecho penal internacional para dar cuenta del proceso por el cual los crímenes relacionados con el género han sido reconocidos en el Estatuto de Roma. A continuación analizamos la aplicación del derecho penal internacional en ciertos casos de crímenes por motivios de género para mostrar los obstáculos que persisten para una verdadera consideración de los intereses del género por el derecho, y finalmente discutimos la forma en que la jurisprudencia de la cpi podría tener un impacto más amplio sobre el reconocimiento del género en otros ámbitos del derecho internacional o nacional. |
