| Summary, etc. | La présente contribution établit une synthèse des éléments auxquels l’hôpital et le personnel soignant doivent être attentifs dans la mise en œuvre d’une contention, ensuite d’un examen du cadre légal, réglementaire et jurisprudentiel belge applicable à la contention en tant que moyen d’immobilisation des patients dans les hôpitaux généraux. L’objectif poursuivi est d’informer tant les prestataires de soins de santé que les praticiens du droit sur cette technique de contrainte et de les sensibiliser afin d’assurer un équilibre entre le devoir de sécurité et de surveillance du personnel soignant et les droits fondamentaux du patient. |

| Summary, etc. | This contribution establishes a summary of the elements to which the hospital and nursing staff must be attentive when implementing restraint. It also contains an examination of the Belgian legal, regulatory and jurisprudential framework applicable to restraint as a means of immobilization of patients in general hospitals. The objective pursued is to inform both healthcare providers and legal practitioners about this technique of restraint and to raise their awareness in order to ensure a balance between the duty of security and surveillance of healthcare personnel and the fundamental rights of the patient. |
