| Summary, etc. | L’équilibre a toujours été présent dans les écrits relatifs à la théorie de la séparation des pouvoirs mais demeure une donnée controversée pour les juristes, notamment parce qu’elle est appréhendée dans sa version statique qui conduit à une neutralisation des forces. À partir d’une analyse dynamique de l’équilibre, cette étude propose de questionner les vertus explicatives de l’équilibre au sein du principe de la séparation des pouvoirs et de dépasser les querelles doctrinales. L’équilibre est ici envisagé comme une clé de compréhension de la théorie de la séparation des pouvoirs en même temps qu’il révèle les pouvoirs de la séparation. Discipline : droit |

| Summary, etc. | Balance has always been present in the literature on the theory of the separation of powers, but remains a controversial notion for jurists because it is considered in its static version which leads to a neutralization of forces. Through a dynamic analysis of balance, this study proposes to question the explanatory virtues of balance within the principle of the separation of powers and to overcome doctrinal disputes. Balance is here seen as a key to understanding the theory of the separation of powers at the same time as it reveals the powers of separation. |
