Une recherche menée au tribunal de première instance de Bruxelles, sur base de 39 dossiers judiciaires contenant un rapport d’expertise et une décision consécutive, montre que le juge suit fidèlement l’avis de l’expert et révèle un glissement du pouvoir décisionnel des mains du juge vers celles de l’expert. Dès lors, si les échanges entre juristes et « psy » sont à encourager dans les domaines où ils interagissent, il faut veiller à ce que les rôles ne se confondent pas, la différence des missions devant être préservée. |

| Summary, etc. | When judges and experts in psychology meet on family matters. A study carried out at Brussels’ court of first instance (tribunal de première instance) – based on 39 judicial files each containing an expert report and a subsequent decision – shows that judges faithfully follow the experts’ opinion and reveals that the decision-making power shifts from the hands of the judges to these of the experts. Therefore, if contacts between judges and psychologists are to be encouraged in those areas where they interact, their roles must not become mixted up given that the difference between their missions must be preserved. |
