| Summary, etc. | Ce tour d’horizon rétrospectif des applications que j’ai faites de la sémiotique au droit s’ouvre sur une confrontation entre positivisme juridique et positivisme sémiotique. Je présente ensuite la conception greimassienne de la narrativité et mets l’accent sur la notion de « typifications narratives » de l’action et sur la nécessité d’envisager la pragmatique en termes narratifs, ce qui conduit à une réflexion sur les rapports entre droit et fait. Les parties suivantes sont consacrées à l’approche sémiotique des problèmes du témoignage, de l’interaction à l’intérieur du tribunal, du résumé produit par le juge, des récits sous-jacents à la décision juridictionnelle et du verdict « non coupable ». Passant enfin au contexte du droit religieux principalement juif, j’analyse tour à tour les problèmes de la médiation divine, du langage du droit biblique et de ses principes, des rapports entre droit et récit dans la Bible ainsi qu’entre concepts et institutions juridiques, et finalement entre « vérité », « confiance » et règle de droit. La conclusion traite des implications méthodologiques de ce qui précède et revient sur des problèmes d’ordre ontologique. |

| Summary, etc. | A Journey into Legal SemioticsThis retrospective review of my applications of semiotics to law begins by contrasting legal and semiotic positivism, and continues with a section on narrativity in the Greimasian tradition (where I stress narrative typifications of action, and emphasize the importance of the narrativization of pragmatics). Topics covered include Law and Fact, Witnessing, Courtroom Interaction, the Judicial Summing-up, narratives underlying the judicial decision, the "not guilty" verdict, and, in the context of religious (mainly Jewish) law: the mediation of the divine, the language of Biblical law and its principles, law and narrative in the Bible, legal concepts and institutions, truth and trust as underlying rules. The concluding section includes methodological implications and ontological radicalism. |
