| Summary, etc. | La loi du 8 août 2016 vient de réformer le régime juridique de l’inaptitude du salarié et de ses conséquences. Après émission de l’avis d’inaptitude par le médecin du travail, l’employeur doit faire des recherches pour envisager le reclassement du travailleur. Si aucun emploi n’est disponible ou ne convient à l’intéressé, l’employeur doit procéder à son licenciement dans le délai d’un mois. Le motif de la rupture peut être contesté désormais devant le conseil de prud’hommes. |
