Cet indicateur est né en réaction aux rapports Doing Business de la Banque mondiale selon lesquels la common law serait plus propice au développement économique que le droit continental. L’article en décrit la genèse, dévoile la stratégie des acteurs impliqués, détaille de façon critique la façon dont il est élaboré et met en lumière la conception de la sécurité juridique produite par l’indicateur. L’article montre que, plus que la sécurité juridique, l’indicateur évalue, en adoptant le point de vue de l’investisseur étranger, la présence de conditions juridiques jugées nécessaires à la sécurité et au bon déroulement des relations économiques dans un ordre juridique donné. |

| Summary, etc. | The Index of Legal Certainty is an indicator issued by the Civil Law Initiative which is aimed at measuring legal certainty in various national legal systems. This indicator was created in reaction to the World Bank’s “Doing Business” reports, according to which common law systems are better for economic growth than continental systems. The article intends to describe its genesis, unveil the actors’ strategy, critically detail the way it is built and characterize the conception of legal certainty produced by the indicator. The article shows that the indicator does not measure legal certainty as such; rather, from the perspective of a foreign investor, it evaluates the presence of legal conditions deemed necessary for the safe and successful conduct of economic relations in a given legal order. |
