| Summary, etc. | Le rapport d’activité pour 2015 du Défenseur des droits témoigne de l’envergure de l’action menée par cette autorité dotée d’un statut constitutionnel et de nombreux moyens d’action. Le rapport fait état d’un nouveau positionnement stratégique qui donne « une place centrale à la promotion de l’égalité, à la lutte contre les discriminations et à l’accès aux droits » par le redéploiement du réseau territorial de l’Autorité et le lancement d’une enquête nationale pour identifier et mieux comprendre les situations d’inégalité et de non recours aux droits. Considérant que le droit à la santé « constitue un droit fondamental, pivot sans lequel on ne peut être en capacité d’exercer ses autres droits », l’action du DDD s’est portée sur le rétablissement de l›égalité des personnes dans l›accès aux droits en matière de santé en identifiant des obstacles objectifs, tels que les inégalités territoriales ou la carence des services publics, et des obstacles personnels résultant de situations de vulnérabilité. Le DDD a également mené une politique de lutte contre les discriminations fondées sur l’état de santé ou le handicap et s’est prononcé sur des questions bioéthiques relatives au transsexualisme, à la PMA et à la GPA. |

| Summary, etc. | Access to rights and equality of rights in the field of health in the 2015 activity report of the commissioner for human rightsThe 2015 activity report of the Commissioner for Human Rights testifies to the scale of the action of this authority which has a constitutional status and numerous means of action. The report mentions a new strategic position which attributes “ a central place to the promotion of equality, the struggle against discrimination and access to rights” by redeploying the Authority›s territorial network and launching a national study to identify and better understand situations of inequality and non-recourse to rights. Considering that the right to health “ constitutes a fundamental right, a pivotal point without which one cannot be in a position to exercise one’s other rights”, the Commissioner for Human Rights’ action extended to re-establishing the equality of individuals in their access to rights in the field of health by identifying objective obstacles, such as territorial inequalities or the lack of public services, and personal obstacles resulting from situations of vulnerability. The Commissioner for Human Rights also led a policy to combat discrimination based on the state of health or handicap and expressed opinions on bioethical issues relative to transsexualism, ART and surrogacy. |
