Summary, etc. | The independence of Algeria raised the question of the nationality of its inhabitants: what nationality for the French Muslims of Algeria, the Pieds-noirs, the Jews of Algeria? The nationality code of 1963 distinguished between nationality of origin and nationality of acquisition. The original Algerian nationality was automatically attributed only to French Muslims on the basis of the enjoyment of “Muslim status” through double paternal lineage born in Algeria. This criterion had the other consequence of introducing an ambiguity with structuring effects: while the “Muslim status” of the colonial period was not of a confessional order, it took on the appearance of it in the nationality code, thus making it fluid and “natural” the link between nationality, identity, Islam and Arabness, these last two elements being also given as characteristics of the Algerian nation. The late inclusion of Amazighness among its characteristics does not fundamentally transform its nature which, from ethno-religious, becomes at best ethnocultural. On the other hand, the consecration in 2005 of bi-nationality, which implies indifference to etnic, religious or cultral affiliations affects such a conception of the nation. |

Summary, etc. | L’indépendance de l’Algérie posait la question de savoir quelle nationalité attribuer à ses habitants d’alors, musulmans, pieds-noirs et juifs. Le code de la nationalité de 1963 distingua entre nationalité d’origine et nationalité d’acquisition. La nationalité algérienne d’origine fut attribuée d’office aux seuls Français musulmans sur la base de la jouissance du « statut musulman » par une double filiation en ligne paternelle née en Algérie. Ce critère eut pour autre conséquence d’introduire une ambiguïté aux effets structurants : alors que le « statut musulman » de la période coloniale n’était pas d’ordre confessionnel, il en prit l’apparence dans le code de la nationalité rendant ainsi fluide et « naturel » le lien entre nationalité, identité, islamité et arabité, ces deux derniers éléments étant par ailleurs donnés pour caractéristiques de la nation algérienne. L’inclusion tardive de l’amazighité parmi ses traits marquants n’en transforme pas fondamentalement la nature qui, d’ethnoreligieuse, devient au mieux ethnoculturelle. En revanche, la consécration en 2005 de la binationalité, qui implique l’indifférence aux affiliations ethniques, religieuses ou culturelles, affecte pareille conception de la nation. |
