| Summary, etc. | How can the norm of “fair and equitable sharing of the benefits arising out of the utilization of Indigenous Peoples and Local Communities” Traditional Knowledge associated with genetic resources’ when it leads to biotechnological breakthroughs be effectively implemented? While the Nagoya Protocol establishes the contractual route for doing so, scientific literature and practice offer little guidance on how to achieve fair and equitable bioprospecting contracts. To fill this gap, this article proposes participatory action-research as a promising methodological approach. Using a real-life example, it shows that, by integrating its founding principles into bioprospecting operations, these become an exercise in building a “relationship” based on radical respect for the Other, beyond any transactional logic. |

| Summary, etc. | Comment assurer une mise en œuvre efficace de la norme instituant le partage juste et équitable des fruits de l’innovation avec les peuples autochtones et les communautés, lorsque leurs savoirs traditionnels sur les vertus des plantes et des animaux inspirent des innovations biotechnologiques ? Si le Protocole de Nagoya institue la voie contractuelle pour ce faire, la littérature scientifique et la pratique clarifient peu les chemins susceptibles de conduire à la conclusion de contrats de bioprospection justes et équitables. Afin de combler ce vide, le présent article suggère que l’approche de la recherche-action participative avec les communautés, usitée en sciences sociales, constitue, d’un point de vue méthodologique, une avenue fertile en l’occurrence. À partir d’un exemple réel, il démontre qu’en intégrant ses principes fondateurs dans les opérations de bioprospection, celles-ci deviennent, par-delà la logique transactionnelle instituée, un exercice de construction d’une « relation » fondée sur le respect radical de l’altérité. |
