| Summary, etc. | In the summer of 1795, at a time when a war on trade was waged in the North Sea between Great Britain and France, a Dutch merchant vessel by the name of the Herstelder was captured by a British warship near Shetland. The capturing party had aimed to bring the ship to Cork in Ireland, but due to a storm and contrary winds, they ended up in Bergen on the western coast of Norway instead. There, the ship was taken in and arrested by the local authorities of the neutral kingdom of Denmark-Norway, and there it would remain for the next eleven years. This article addresses the case of the Herstelder as it ensued, and aims to answer the central questions that were at stake in the controversy it produced: were Great Britain and the Batavian (Dutch) Republic two countries at war at the time of the capture, and who could decide if the Herstelder was a legal prize to the British, once it lay anchored in the port of a neutral country? The answer to the second question depended partly on the answer to the first, but both proved challenging to settle. |

Les ravisseurs avaient l’intention d’amener le navire à Cork, en Irlande, mais en raison d’une tempête et de vents contraires, ils se sont retrouvés à Bergen, sur la côte ouest de la Norvège.
