| Summary, etc. | RésuméLes entreprises françaises sont soumises à un régime de publicité légale qui les oblige à diffuser sans limitation un certain nombre de données à caractère confidentiel. Cette même obligation ne s’imposant pas à la plupart de leurs rivales, les entreprises françaises subissent une distorsion de concurrence qui s’aggrave du fait des progrès réalisés par les technologies de l’information et de la généralisation des pratiques d’intelligence économique. En attendant un hypothétique changement de la part du législateur et du juge, qui se montrent totalement insensibles au handicap ainsi créé de leur fait, les entreprises qui en sont victimes doivent mettre en place des mesures de contre-intelligence qui passent en particulier par des stratégies judiciaires ad hoc. |

| Summary, etc. | According to the French commercial law, most companies are compelled to publish confidential informations such as balance sheets, managers and auditors reports, statutes... Their competitors can legally and easely access to these data, even if their own informations are kept secret. The competition process is widely biased due to generalization of technologies development and competitive intelligence practices. Members of Parliament and judges do not seem to be aware of the threat’s seriousness. For that reason, endangered firms have to conceive counter-intelligence strategies which are founded on ad hoc judicial proceedings.. |
