| Summary, etc. | Depuis plusieurs années, la mer Méditerranée est le théâtre d’actes de violence à l’encontre des personnes migrantes, en partie causés par le refus par les autorités publiques de mener des opérations de secours et sauvetage en mer. Cet article s’appuie sur les contentieux qui ont été traités par les magistrats italiens concernant les migrants qui se sont approchés des frontières italiennes et en expose les caractéristiques les plus pertinentes. L’objectif principal de cette réflexion est d’interroger les responsabilités des autorités publiques s’agissant de non-assistance à des personnes en situation de détresse en mer. Si ces affaires ont connu un fort retentissement médiatique, elles ont donné lieu à des décisions très décevantes des juges dans les cas très rares qui ont pu être portés devant les tribunaux. |

| Summary, etc. | For several years, the Mediterranean Sea has been the scene of some of the most tragic acts of violence perpetrated against migrants, partially caused by the failure of public authorities to conduct rescue operations. This work draws on public and well-known cases tried by Italian magistrates concerning migrants who have approached Italy’s borders, and outlines their most relevant features. The main aim is to investigate the responsibilities of public authorities arising from non-assistance that have had strong media resonance, but have often received a “weak” response from the judicial system in the very few cases that have been brought to court. |
