| Summary, etc. | In order to answer the questions submitted to it in the request for an advisory opinion on the climate obligations of States, the International Court of Justice will have to clarify not only the primary obligations of States, but also "the legal consequences under these obligations for States where they, by their acts and omissions, have caused significant harm to the climate system and other parts of the environment". The question of reparation should therefore play an important role in the Court’s opinion. However, reparation poses particular problems in relation to climate change and its effects. Even if the damage caused by climate change is and will be increasingly irreparable, the obligation to repair remains and even retains its full meaning as a sword of Damocles to encourage the main emitters to act. |

| Summary, etc. | Pour répondre aux questions qui lui sont posées dans la demande d’avis consultatif sur les obligations climatiques des États qui lui a été adressée, la Cour internationale de Justice sera amenée à clarifier non seulement les obligations primaires des États, mais aussi à préciser les « conséquences juridiques pour les États qui, par leurs actions ou omissions, ont causé des dommages significatifs au système climatique et à d’autres composantes de l’environnement ». Ainsi, la question de la réparation devrait occuper une place importante dans l’avis de la Cour. Or, la réparation pose des problèmes particuliers en rapport avec les changements climatiques et leurs effets. Même si les dommages climatiques sont et seront de plus en plus irréparables, l’obligation de réparer demeure et conserve même tout son sens en tant qu’épée de Damoclès pour inciter les principaux émetteurs à agir. |
