| Summary, etc. | Based on neo-institutional theory, this article analyses how institutional pressures can shape regulatory practices and copyright management in the digital age. To this end, we consider digital platforms, in particular the Google search engine and the generative artificial intelligences ChatGPT (OpenAI) and Google Gemini. The use of documentary research allows us to study the conflicts between Google and OpenAI on the one hand, and the traditional press sector on the other, through widely documented legal conflicts. In addition to the legal aspects, we also propose reading grids for understanding the institutional work carried out by the two companies. This research contributes to a more precise understanding of the dynamics induced by the frictions between technological innovation and legal regulation (or even its bypass). | Summary, etc. | En prenant appui sur la théorie néo-institutionnelle, cet article analyse la manière avec laquelle les pressions institutionnelles peuvent façonner les pratiques réglementaires et la gestion des droits d’auteur à l’ère numérique. Dans cette optique, nous considérons des plateformes numériques, et en particulier le moteur de recherche de Google ainsi que les intelligences artificielles génératives ChatGPT (OpenAI) et Google Gemini. Le recours à une étude documentaire nous permet notamment d’étudier les conflits entre, d’une part, Google, OpenAI et, d’autre part, le secteur de la presse classique à travers des conflits judiciaires largement documentés. Au-delà des aspects juridiques, nous proposons également des grilles de lecture pour comprendre le travail institutionnel opéré par les deux entreprises. Cette recherche contribue à une compréhension plus précise des dynamiques induites par les frictions entre l’innovation technologique et la régulation juridique (voire son contournement). Cette manière de procéder permet, selon nous, de mettre en lumière la manière avec laquelle le travail institutionnel peut éventuellement influencer les pratiques sectorielles et la formulation des politiques publiques.
