| Summary, etc. | Open innovation requires balancing the sharing of resources with the preservation of the individual interests of participating actors. This creates a tension between openness and appropriation, raising challenges regarding the protection of innovation. Various protection strategies can be mobilized (patents, copyrights, trademarks, trade secrets, etc.). The choice of strategy depends not only on the stage of the R&D process and the nature of the innovation, but also on the type of organization involved in the collaboration. SMEs, in particular, often lack the legal resources to protect themselves effectively. Specific tensions may arise between partners with significant asymmetries: for example, academic actors collaborating with profit-oriented firms, or large companies partnering with SMEs that lack the financial capacity to use formal protection tools such as patents. Organizations therefore adopt differentiated strategies whose effectiveness depends on their sector of activity, size, and regulatory framework. |

| Summary, etc. | L’innovation ouverte demande à concilier le partage de ressources et la préservation des intérêts propres aux acteurs engagés. Cette situation crée une tension entre ouverture et appropriation, qui soulève des défis quant à la protection de l’innovation. Différentes stratégies de protection peuvent être mobilisées (brevets, droits d’auteur, marques, secrets…). Le choix de la stratégie dépend du stade du processus de R&D et de la nature de l’innovation, mais aussi du type d’organisation engagé dans la collaboration. Les PME, en particulier, manquent souvent de ressources juridiques pour se protéger efficacement. Des tensions spécifiques peuvent exister entre des partenaires qui présentent une dissymétrie importante : des acteurs académiques collaborant avec des entreprises orientées vers le profit ou de grandes entreprises collaborant avec des PME qui n’ont pas la surface financière pour mobiliser des outils formels de protection de l’innovation comme le brevet. Les organisations adoptent des stratégies différenciées dont l’efficacité dépend de leur secteur d’activité, de leur taille et de leur cadre réglementaire. |
