Summary, etc. | This paper focuses on the theoretical and methodological problems highlighted by a study of the role of the law in international relations, in particular its function of legitimization as it may appear in how the problem of the dismemberment of the Yugoslav Federation was tackled by the EU. It argues that the lack of tools provided by international relations theories regarding this question may be overcome by the transposition of the Weberian “ideal-type” of “legal domination” to a topic not normally suited to being understood through such a tool. However, the tool proves relevant in explaining in what circumstances international law can legitimize specific decisions. |
