| Summary, etc. | La singularité du droit pénal, selon Durkheim tient au fait que l'adage « nul n'est censé ignorer la loi » s'y applique sans fiction. Cette connaissance toujours déjà assurée des sujets sociaux que le droit pénal suppose, quel statut lui donner ? Et quelle forme particulière de sanction s'en trouve par là déterminée ? En étudiant les transformations de la réflexion sociologique sur ce sujet, de Durkheim à Fauconnet, on voudrait poser les jalons d'une conceptualisation du droit pénal qui, sans quitter le plan proprement juridique et sans le réduire à n'être que le reflet ou l'instrument de motivations extérieures, s'efforce de saisir le type de prise qu'il exerce sur les événements et les corps, la façon dont il les dissocie et les réarticule, le découpage qu'il opère dans la réalité avec une précision et une exactitude qui n'ont rien d'absolu, puisqu'au fond, elles ne relèvent que de lui. |

| Summary, etc. | The singularity of the penal law, according to Durkheim, is due to the fact that the old saying « Ignorance of the law is no excuse » applies to it without fiction. Which statute to this knowledge always already ensured of the social subjects that penal law implies ? Which form of sanction it determines ? The author wants to show the ways of its conceptualization by studying the transformations of the sociological reflexion on it. This conceptualization, without leaving the properly legal level and reducing it to be only the reflection or the instrument of external motivations, aims to understand the type of catch that penal law exerts on events and bodies, the way it dissociates and articulate them again, the cutting which it operates in reality with a precision and an accuracy which have nothing absolute since they only depend on it. |
