| Summary, etc. | L’inappropriabilité de la Terre comme principe fondamental du droit cosmopolitique, dont les autres droits et devoirs de l’humanité doivent êtres déduits, est susceptible de renouveler le contenu de l’idée du citoyen du monde qui relève d’un droit plus fondamental que celui de la citoyenneté étatique. Cela ne veut nullement dire qu’il faille remettre en cause le droit positif étatique, mais simplement que, au-dessus de celui-ci, il y a un droit du citoyen du monde, donc de l’humanité qui prévaut. Pour Kant, le droit cosmopolitique du citoyen du monde avait pour unique contenu l’hospitalité que l’on doit à celui qui arrive et qui passe. A partir du concept d’inappropriabilité de la terre ce droit s’élargit considérablement : il comporte non seulement le devoir d’hospitalité, mais aussi les droits de l’homme et en outre le droit à bénéficier des fruits de la Terre en vue d’avoir une existence décente. Le tout définissant la responsabilité cosmopolitique pour l’humanité. |

| Summary, etc. | The inappropriability of the earth as a fundamental principle of cosmopolitical rights, from which other rights and duties of humanity should be deduced, has the capacity to renew the content of the idea of world-citizen, based on a more fundamental right than that of state citizenship. This in no way means a need to question the positive right of states, but simply that above that right lies that of the citizen of the world (i. e. of humanity), which prevails. For Kant the only content of the cosmopolitical rights of the world-citizen was the hospitality owed to whoever arrives and goes on his way. From the concept of the earth’s inappropriability, this right extends considerably in scope : it includes not only the duty of hospitality, but also human rights and, further, the right to benefit from the fruits of the earth with a view to a decent existence. The whole defines cosmopolitical responsibility for humanity. |
