| Summary, etc. | Loin d’épouser le schéma d’un État fédéral (inachevé), la structure juridique fondamentale de l’Union européenne est celle d’une union cosmopolitique au sens où Kant en avait exposé l’épure dans « La Paix perpétuelle », selon trois « niveaux de relations du droit public » ( ius civitatis, ius gentium, ius cosmopoliticum). Cependant, la dynamique de l’intégration européenne fait émerger des différenciations déroutantes : entre citoyenneté et nationalité, peuple et nation, autorité et souveraineté, souveraineté négative et souveraineté positive, droit international et droit transnational, État et Constitution. En ce qui concerne l’Europe (cosmo) politique, cela ne va pas sans difficulté. L’Union doit en effet faire face à des difficultés internes de responsabilité, d’autorité, de représentativité politiques – bref de légitimité politique du projet européen lui-même, dont il est urgent de repenser les finalités. |

| Summary, etc. | Far from using the scheme of an (uncomplete) federal State, the fundamental legal structure of the European Union is of a cosmopolitical union as sketched by Kant in « Perpetual Peace » – according three « levels of relationship to public law » ( ius civitatis, ius gentium, ius cosmopoliticum). However, the process of European integration brings out confusing distinctions : between citizenship and nationality, people and nation, authority and sovereignty, negative and positive sovereignty, international and transnational law, State and Constitution. As regards the (cosmo) political Europa, the Union must face internal difficulties of political responsibility, authority, and representativeness – i. e. about the political legitimacy of the European project itself. It is imperative to reconsider its purposes. |
