| Summary, etc. | Cet article aborde la question de la sexualité rémunérée en interrogeant la façon dont le droit français différencie des activités qui impliquent toutes des pratiques sexuelles échangées contre de l’argent. Mon hypothèse est que ces activités s’inscrivent dans des espaces discursifs très différents, qui ont produit des figures ‘prostitutionnelles’ contrastées qu’on ne saurait réduire à des stéréotypes de genre prédéterminés. Une analyse du droit au prisme du genre implique ainsi que l’on reste attentive à la transformation de ces stéréotypes — à la multiplicité des intérêts des femmes, donc, et à l’inversion possible des rapports de pouvoir, les conséquences de ces régimes pouvant faire l’objet d’interprétations variées. |

| Summary, etc. | The Legal Construction of Prostitution. Three Differentiated StoriesThis article explores the issue of remunerated sex by examining the way in which French law differentiates between activities that all imply that sexual practices are exchanged for money. The hypothesis is that these activities are defined within very different discursive spaces, which have produced contrasting ‘prostitutional’ figures that cannot be reduced to predetermined gender stereotypes. An analysis of the law through the prism of gender thus implies that we should stay attentive to the transformation of these stereotypes: legal narratives are open to varied interpretations and can accommodate a multiplicity of definitions of women’s, and to the possible inversion of power relations. |

| Summary, etc. | En este artículo se aborda el tema de la sexualidad remunerada cuestionando la forma en que el derecho francés distingue las actividades que implican todas las prácticas sexuales a cambio de dinero. Mi hipótesis es que estas actividades se inscriben en muy diferentes espacios discursivos, que han producido figuras’prostitucionales’ contrastadas que no podríamos reducir a estereotipos de género predeterminados. Un análisis del derecho desde la perspectiva de género implica entonces que nos mantengamos atentos a la transformación de estos estereotipos – entonces a la multiplicidad de los intereses de las mujeres y a la posible inversión de las relaciones de poder, las consecuencias de estos regímenes pueden dar lugar a diversas interpretaciones. |
