| Summary, etc. | La protection du loup s’étiole en France, les conditions permettant de déroger à l’interdiction de porter atteinte à l’espèce devenant de plus en plus souples. L’objectif semble être de lever les freins juridiques qui réduisent l’efficacité des dérogations accordées par les préfets et d’atteindre le plafond national de destruction qui est relevé d’année en année. Il est loisible de voir en cela un passage d’un paradigme de protection des troupeaux à un paradigme de régulation de l’espèce. La loi du 1er octobre 2014 d’avenir pour l’agriculture, l’alimentation et la forêt qui inclut le loup dans le champ d’application des battues administratives aux animaux nuisibles, conforte cette analyse, la référence à cette espèce ayant été supprimée en 2001. La conformité des dernières évolutions du droit français en la matière aux textes européens concernant la protection du loup est cependant douteuse. Il n’existe, en effet, qu’assez peu de précédents jurisprudentiels permettant de déterminer le niveau d’exigence de la CJUE. |

| Summary, etc. | The wolf: from herd protection to species regulationIn France, wolf protection is weakened. The conditions to depart from the interdiction to cause damage to this species are more and more flexible. It seems that the objective is to remove any legal break that could reduce the efficiency of derogations allowed by the reeves to reach the national quota of destruction, which is increased every year. The regime of protection can be seen now as a regime of regulation. The law of October 1st of 2014 for agriculture as integrated the wolf as a species susceptible to be hunted within the frame of administrative hunting although it has been removed from it since 2001. However, we can doubt of the conformity of these reforms to European Law. Indeed, the jurisprudence of the CJUE isn’t specific enough for now to determine the level of exigence it requires. |
