Summary, etc. Le législateur italien a choisi de donner, pour la première fois, une définition explicite du concept juridique d’« environnement », l’introduisant dans le texte normatif le plus important dans le domaine environnemental, c’est-à-dire le décret législatif du 3 avril 2006, n˚ 152 (le Code de l’Environnement, ainsi dit). Il s’agit d’une nouveauté de grande importance, si l’on considère surtout l’originalité et la complexité de la formule législative. Dans cette contribution, l’on propose de lire cette définition juridique de l’« environnement » à la lumière d’un paradigme conceptuel qu’elle présuppose : le modèle des «  social-ecological systems » (SESs). Dans cette interprétation, l’environnement, conçu d’un point de vue juridique, ne s’épuise pas dans les écosystèmes ni dans les socio-systèmes considérés individuellement et séparément, mais il s’élève à un méta-système socio-écologique de systèmes écologiques et sociaux, qui interagissent en s’organisant en un tout qui est plus la somme de ses parties et qui manifeste des propriétés émergentes. Les conséquences qui en dérivent sont remarquables également pour le droit de l’environnement en tant que discipline : il confirme sa vocation de droit “fédérateur”, parce qu’il ne prive, ni destitue, ni substitue des branches juridiques différentes, mais les coordonne et les intègre à un niveau de réglementation plus complexe.

Summary, etc. The Legal Concept of the Environment in the Light of the Definition Given by the Italian LegislatureItalian legislature has provided an explicit definition of the legal concept of the « environment » by inserting it into the milestone in Italian environmental legislation, i.e. Legislative Decree 3 April 2006, no. 152 (the so-called Environmental Code). This is a valuable innovation considering the originality and complexity of the Italian legal definition. This article suggests that the social-ecological systems (SESs) model can be considered an implied conceptual framework for interpreting the legal definition of the « environment » in Italian law. According to this interpretative proposal, the environment in the legal sense cannot be reduced to ecological systems or social systems considered individually and separately, because it is a meta-system, including both social and ecological systems which interact and organize themselves into a whole that is more than the sum of its parts and has its own emergent properties. The consequences arising from this conceptual framework are significant for Environmental Law as an academic discipline. Environmental Law is a ‘federative’ law because it does neither deprive nor override other legal branches, but coordinates and integrates them into a higher and more complex level of regulation.
